National Interest Waivers (NIW)

National Interest Waiver (NIW):

Current law provides for immigration without labor certification or job offer for certain highly qualified individuals whose immigration is "in the national interest." This petition category will apply if the alien can show that his/her services in the sciences, arts, or business will greatly benefit the nation. National Interest Waivers are often used by physicians working in shortage areas or veterans facilities. This strategy can have unique benefits since it requires no job offer or labor certification and can support a simultaneously filed application for adjustment of status as well as work authorization.
